§ 1 Scope

These General Terms and Conditions apply to all orders placed by consumers through our online shop at www.bambisleep.de . A consumer is any natural person who enters into a legal transaction for purposes that are predominantly neither commercial nor self-employed (Section 13 of the German Civil Code).

§ 2 Contracting parties, conclusion of contract

The purchase contract is concluded with Evim Mobilya GmbH. The presentation of products in the online shop does not constitute a legally binding offer, but rather a non-binding online catalog. You submit a binding offer by completing the ordering process and clicking the " Order with payment " button. Confirmation of receipt of the order is sent automatically via email and does not constitute acceptance of the contract. Acceptance occurs through an express declaration of acceptance, shipping confirmation, or delivery.

§ 3 Prices and shipping costs

All prices are in euros and include VAT (currently 19%), plus shipping costs. Any shipping surcharges for bulky items will be displayed during the ordering process.

§ 4 Delivery time

Our products are handmade and require a delivery time of 6 to 12 weeks from receipt of payment or acceptance of the financing application. When ordering multiple items, the longest delivery time applies.

§ 5 Methods of payment

Payment can be made using the following methods:

Credit and debit card

Klarna (invoice, installment purchase, instant bank transfer)

PayPal (also installment payments)

Shop Pay, Apple Pay, Google Pay (Shopify Payments)

Depending on your selection, we will automatically redirect you to the payment processing. For Klarna, Klarna's terms and conditions also apply.

§ 6 Cancellation & Cancellation Fee

Since most of these items are custom-made, cancellation after the contract has been concluded is generally not possible. In individual cases, cancellation may be made subject to a flat-rate cancellation fee of 25% of the purchase price . This fee covers any costs and expenses already incurred.

§ 7 Retention of title

The goods remain the property of Evim Mobilya GmbH until full payment has been made.

§ 8 Warranty

The statutory warranty rights apply. The limitation period is two years from delivery of the goods.

§ 9 Liability

We are liable without limitation in cases of intent, gross negligence, and injury to life, body, or health. In the case of slightly negligent breaches of essential contractual obligations, liability is limited to typical, foreseeable damages.

§ 10 Right of withdrawal

There is no right of withdrawal in the following cases:

individually manufactured goods

products specially configured for the customer

Unless otherwise excluded, the statutory cancellation period is 14 days.

§ 11 Online Dispute Resolution

The EU Commission provides a platform for online dispute resolution: https://ec.europa.eu/consumers/odr

We are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.

§ 12 Place of jurisdiction and applicable law

German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. The place of jurisdiction for merchants is Hanau.

§ 13 Severability Clause

Should individual provisions be or become invalid, the validity of the remaining provisions shall not be affected.
